Rules and Regulations

This is a series of four cruises.


Our first Cruise is known as The National Treasure Hunt Cruise in search of Mayan Gold © and will be traveling the Western Caribbean;

The second cruise is known as The National Treasure Hunt Cruise in search of the Pirates of the Caribbean © and will be traveling the Eastern Caribbean;

The third cruise is known as The National Treasure Hunt Cruise in search of Pharaoh’s Treasures © will be sailing the Mediterranean;

The fourth cruise in the series is known as The National Treasure Hunt Cruise in search of the missing Yukon © will be sailing the Alaskan waters.

Each cruise will be a minimum of 7 days of cruising and have its own Grand Prize winner.

Participants will participate in a chance of skill requiring them to complete/solve a total of fifteen (15) clues/activities where each clue/activity solved is worth a predetermined number of points and each clue/activity has a different degree of difficulty.  Each participant will be given a special T-Shirt for participating, as well as the possibility of winning other gifts.  The Grand Prize is Ten Thousand Dollars USD ($10,000.00).  The winner of the game, should they accept to play and continue on, will be given free berth for two in an Ocean View Cabin (taxes and fees not included) on the next cruise and the chance to win even more.


 

Game of Skill – Official Rules

INTRODUCTION:

The Official Rules and Restrictions (the "Official Rules") apply only to guests of First Orlando Productions (“Sponsor”) who have purchased The National Treasure Hunt Cruise in Search of the Mayan Gold package through authorized travel agencies and are cruising on the Carnival Valor on August 30 through September 6, 2009. By participating in this game of skill, you acknowledge that you have read these Official Rules as well as the Terms and Conditions, and that you agree to abide by, and be subject to, the Official Rules and the Terms and Conditions, as well as the decisions of the judges, which shall be final and binding in all respects. In these Official Rules, "you," "your" and "participants" refers to you, the person who has enrolled in The National Treasure Hunt Cruise in Search of the Mayan Gold.

1. GAME OF SKILL: THE NATIONAL TREASURE HUNT CRUISE IN SEARCH OF THE MAYAN GOLD IS A GAME OF SKILL:

The National Treasure Hunt Cruise in Search of the Mayan Gold is a skill contest designed to provide entertainment for the guests of First Orlando Productions over the week of August 30 - September 6, 2009. To win, participants must complete/solve a total of fifteen (15) clues/activities. Each clue/activity will be worth a predetermined number of points, and will vary by the degree of difficulty. The results of several clues/activities will be judged by a panel of judges appointed by the Sponsor, who will award points based on pre-set criteria. The winner of The National Treasure Hunt Cruise in Search of the Mayan Gold will be the entrant who completes all of the clues/activities and receives the highest total of points. Chances of winning are dependent upon the total number of entrants.  The participants involved in this cruise are aware of the use of their photos, voice, film, theatrical release, DVD , media release and sales of all types, versions, electronic, film, video, tape, or any other type of media and so give their full authorization for such use without receipt of renumeration of any kind.

2. THE NATIONAL TREASURE HUNT CRUISE IN SEARCH OF THE MAYAN GOLD ENTRY:

To enter, you must have purchased The National Treasure Hunt Cruise in Search of the Mayan Gold package from an authorized travel agncy; and be registered on the Carnival Valor Cruise through one of the participating travel agencies and /or agents checked onto the cruise ship as a guest for August 30 - September 6, 2009. Reservations must be made at least 120 days before date of arrival. Reservations can be made by emailing to info@thefirstorlando.com or contacting any of the participating travel agencies or agents. Only one entry per guest room per stay; (Occupancy by no more than five (5) individuals per guest room is allowed or room capacity is allowed by cruise line). Individuals occupying a single guest room will comprise a team, referred herein as “Team”. Each team may submit no more than one (1) entry.

3. GRAND PRIZE WINNER SELECTION:

Sponsor will award one Grand Prize to one winner. The winner will be determined by judges appointed by the Sponsor based on the following criteria:

To be eligible for the Grand Prize, you must satisfy the Official Rules and the Terms and Conditions;

You must sign all waivers and agreements as required by the Sponsor;

You must participate in The National Treasure Hunt Cruise in Search of the Mayan Gold;

You must attend a pre-scheduled orientation session on the cruise ship on the day you check-in during which time the rules and regulations of The National Treasure Hunt Cruise in Search of the Mayan Gold will be reviewed;

You must complete the requirements of all fifteen (15) clues/activities comprising The National Treasure Hunt Cruise in Search of the Mayan Gold;

You must also submit an entry for the Tie-Breaker Challenge at the same time that you submit your completed The National Treasure Hunt Cruise in Search of the Mayan Gold entry;

You must submit your entry and Tie-Breaker Challenge entry to the designated recipient at First Orlando Productions on board the Carnival Valor by no later than Monday, August 31, 2009 at 5pm EST.

One grand prize will be awarded to the one participant with the highest score on The National Treasure Hunt Cruise in Search of the Mayan Gold, as judged by a panel of judges appointed by the Sponsor from among all eligible entries in The National Treasure Hunt Cruise in Search of the Mayan Gold. In case of a tie, winner will be determined by a tie-breaker challenge. The participant with the highest score on the tie-breaker challenge will be awarded the grand prize. Participants will be required to submit their entry for the tie-breaker challenge at the same time that they submit their final entry for The National Treasure Hunt Cruise in Search of the Mayan Gold.  Participants who have not submitted the tie-breaker challenge will not be eligible to win the grand prize.

Winner will be determined on Saturday September 5, 2009 at 7pm EST. All decisions by the judges shall be final. Winner does have to be present at the time of determination.

4. PRIZE:

There will be one Grand Prize winner of The National Treasure Hunt Cruise in Search of the Mayan Gold.

GRAND PRIZE WINNER: One Grand Prize winner will receive $10,000 USD cash prize.

The Grand Prize awarded may be subject to legal restrictions. In the event that the award of the Grand Prize to the winner of The National Treasure Hunt Cruise in Search of the Mayan Gold is challenged by any legal authority, Sponsor has the sole right to determine whether or not to award such prize and whether or not to refund previous payments made by you. In such an event, the Released Parties (defined below) shall have no liability to any participants. The prize will be awarded regardless of the number of participants registered. Prize is not transferable and no substitution of prizes is permitted. ALL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF THE GRAND PRIZE IS THE SOLE RESPONSIBILITY OF THE WINNER. Sponsor will report the award of the Grand Prize to the Internal Revenue Service and other applicable taxing authorities.

NOTIFICATION AND ACCEPTANCE: The Grand Prize winner will be notified by email and/or regular mail within seven (7) days after the date the winner is determined. Winners must sign and return an affidavit of eligibility and acceptance of these Official Rules and a publicity/liability release (unless prohibited by law) within fifteen (15) days after receipt of notification. Failure to comply with these requirements may result in disqualification and the selection of the participant with the next highest ranking (based on total points). Any prize notification returned as undeliverable may result in disqualification and selection of an alternate winner. Sponsor will attempt to contact winner via phone and/or email in order to fulfill the grand prize at least 3 times or for a period of 30 days. If the winner is unable to be reached, this may result in disqualification and selection of an alternate winner. Winner will receive their prize within 6 to 8 weeks of Sponsor's receipt of the signed form.

5. ELIGIBILITY:

This game is open to residents of jurisdictions where this contest is permissible by law. Persons under the age of 18 years may participate in the contest only when accompanied by a parent or legal guardian. All federal, state and local laws and regulations apply. Directors, officers, employees, representatives, agents and consultants of Sponsor, First Orlando Consulting, Inc. (defined below) and each of their respective distributors, divisions and subsidiaries, their immediate families, and directors, officers, consultants, representatives, agents and employees of the game promotional partners are not eligible to win any prize. Recipients of complimentary/promotional package accommodations are eligible to compete for the Grand Prize.

6. TERMS:

By participating in The National Treasure Hunt Cruise in Search of the Mayan Gold, you (and if you are a minor, your parents or legal guardian) release and agree to hold harmless Sponsor, First Orlando Consulting, Inc. and each of their respective affiliates, directors, officers, employees, consultants, and agencies (collectively, the "Released Parties") from any liability whatsoever for any claims, costs, injuries or damages of any kind arising out of or in connection with The National Treasure Hunt Cruise in Search of the Mayan Gold, or acceptance, possession, or use of any prize (including without limitation, claims, costs, injuries and losses related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional) whether under a theory of contract, tort (including negligence), warranty or other theory.

7. RULES OF CONDUCT:

The following rules will apply to all participating teams while competing on-site on the Carnival Cruise Lines © Carnival Valor during The National Treasure Hunt Cruise © in Search of the Mayan Gold. Any team or individual within a team, found to be in breach of any of these rules will automatically be disqualified, with no refund. Should an individual be found in breach of any of these rules, the entire team will be disqualified, with no refund. The decision of the Sponsor is final.

  • A team will comprise only those guests occupying the same guest room. To qualify, one of the guests must be an adult 18 years of age or older. Children under the age of 18 may not participate without an adult. 
  • A team may NOT seek the help of any outside influences, paid or unpaid, including but not limited to family or friends, other guests, the employees of First Orlando Consulting, Inc. or any of their partners or vendors. 
  • A team may not seek the help of any other team for any reason – any questions related to The National Treasure Hunt Cruise in Search of the Mayan Gold must be addressed to the designated judges (to be fully disclosed during The National Treasure Hunt Cruise in Search of the Mayan Gold Orientation session) 
  • Teams must work independently of one another; teams may not work together in any way. Information (including but not limited to the solution to any of the clues/activities in The National Treasure Hunt Cruise in Search of the Mayan Gold) may not be shared between teams at any time. 
  • Participants may not in any way infringe upon the rights of another team to compete in the challenge. 
  • Participants may not put themselves, or any other guest or employee of First Orlando Consulting, Inc., in harm’s way.
  • Participants are forbidden from causing damage to the grounds and property of Carnival Cruise Lines Valor. 
  • Collusion amongst teams is absolutely prohibited.
  • During The National Treasure Hunt Cruise in Search of the Mayan Gold all participants must obey all rules as set out by the Sponsor, as well as all laws of the State of Florida, or any countries laws while visiting those said countries.

If, for any reason, any portion of The National Treasure Hunt Cruise in Search of the Mayan Gold is not capable of being conducted as planned, then Sponsor reserves the right to modify, suspend or cancel the game or any portion thereof. Sponsor reserves the right, at its sole discretion, to disqualify any participant who violates these Official Rules or the associated Terms and Conditions incorporated herein, or who tampers with the enrollment process, or who engages in any conduct detrimental to any of the Released Parties, the game or any other participant (in each case, as determined by Sponsor in its sole discretion), to suspend or terminate any participant whose eligibility is in question, and to cancel, terminate, modify, or suspend this game at any time.

8. LIMITATIONS OF LIABILITY:

By participating in The National Treasure Hunt Cruise in Search of the Mayan Gold, you agree to release and hold harmless Sponsors, their respective parent and related companies, and each such company’s respective officers, directors, employees, and agents (collectively, the “Released Parties”) from and against any claim or cause of action arising out of participation in the Game or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Game; (b) technical or printing errors; (c) lost, late, postage-due, misdirected or undeliverable mail or email; (d) errors in the administration of the Game or the processing of entries; or (e) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from your participation in the Game or receipt or use of any prize. You further agree that in any cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in the Game, and in no event shall the Released Parties be liable for attorneys’ fees.
Released Parties assume no responsibility for, and will not be liable for, any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of entries. Released Parties assume no responsibility for lost, late, misdirected, incomplete or illegible entries.

9. OFFICIAL RULES/WINNERS LIST:

Participating in The National Treasure Hunt Cruise in Search of the Mayan Gold is subject to these Official Rules and the Terms and Conditions and any other rules expressly referenced herein. For winner information (available after September 10, 2009) or an additional copy of the Official Rules, send a self-addressed, stamped envelope to: First Orlando Consulting, Inc., The National Treasure Hunt Cruise in Search of the Mayan Gold Specify, PO Box 161476, Altamonte Springs, Florida 32716-1476.  Requests for official rules must be received by October 28, 2009.
A winners' list may be obtained after September 10, 2009 by sending a self addressed stamped envelope to the address above, Attn: Winners' List.

10. MISCELLANEOUS:

The section headers contained herein are provided for convenience purposes only and shall not be used to modify or interpret these Official Rules. In the event that any provision of these Official Rules (or Terms and Conditions) is found invalid or unenforceable pursuant to judicial decree or decision, the remainder of the Official Rules (and Terms and Conditions) shall remain valid and enforceable according to its terms. The parties intend that the provisions of these Official Rules be enforced to the fullest extent permitted by applicable law. Accordingly, the parties agree that if any provisions are deemed not enforceable, they shall be deemed modified to the extent necessary to make them enforceable. Sponsor reserves the right to change these Official Rules at any time, in its sole discretion.

Sponsor reserves the right to halt, modify or suspend The National Treasure Hunt Cruise in Search of the Mayan Gold at any time for any reason.

In the event that the game is challenged by any legal or regulatory authority, Sponsor reserves the right to discontinue or modify the game or to disqualify residents in the affected geographic area. In such event, Sponsor shall have no liability to any players who are disqualified due to such an action. This contest may not be used for any form of gambling.

Inquiries concerning entries will not be accepted.

11. GAME ADMINISTRATION:

By participating, participants agree that Sponsor, in its sole discretion, will be responsible for resolving any disputes and rules violations that arise in connection with the Contest. All decisions by Sponsor regarding the Contest shall be final and binding in all respects. If you have any questions regarding the Contest, please send an e-mail to info@thefirstorlando.com.

These Official Rules will be governed and construed in accordance with Florida law, without regard to conflict of law principles in the Florida courts.
